Thank you for choosing VanDeusen Photography. These Terms of Sale apply to purchases made through our website, online checkout links, digital invoices, gift certificate pages, online galleries, or any other online ordering platform used by VanDeusen Photography.

By purchasing a gift certificate, portrait product, artwork, digital image, event product, or other item from VanDeusen Photography, you agree to the terms below.

1. Purchases and Payment

All prices are listed in U.S. dollars. Payment is due at the time of purchase unless other written arrangements have been made.

Orders are not confirmed until payment has been successfully received. VanDeusen Photography reserves the right to correct pricing errors, product description errors, or checkout errors before fulfilling an order.

Applicable sales tax, shipping, delivery, or handling charges may be added where required.

2. Gift Certificates

Gift certificates purchased from VanDeusen Photography may be applied toward eligible portrait sessions, artwork, printed products, albums, image boxes, digital image purchases, or other services/products offered by VanDeusen Photography, unless the certificate states a specific limitation.

Purchased gift certificates:

Do not expire.
Do not lose value over time.
Are not subject to dormancy, inactivity, or service fees.
Are not redeemable for cash except where required by law.
May not be replaced if lost, stolen, deleted, or used without permission, unless VanDeusen Photography is able to verify the original purchase and remaining balance.
May be transferred to another recipient, unless the certificate specifically states otherwise.
May not be resold, bartered, or used for unauthorized promotions.

Gift certificates retain the dollar value paid at the time of purchase. Portrait pricing, product pricing, collections, availability, and service offerings may change over time. If a gift certificate was purchased for a specific package, promotion, or session type, VanDeusen Photography will make reasonable efforts to honor the original offering as described; however, if that offering is no longer available, the certificate may be applied as a credit toward current offerings.

Gift certificates may not be combined with certain promotions, discounts, donated certificates, auction certificates, limited edition offers, or special event pricing unless specifically stated in writing.

3. Promotional, Donated, Auction, or Complimentary Certificates

Promotional, donated, auction, referral, complimentary, contest, giveaway, or bonus certificates are different from purchased gift certificates.

These certificates may include specific restrictions, such as eligible session types, product minimums, usage deadlines, booking deadlines, blackout dates, donation terms, or one-per-client limitations. Any expiration date or usage limitation listed on a promotional, donated, auction, or complimentary certificate applies only to that promotional value.

Promotional certificates are not redeemable for cash, may not be transferred unless stated in writing, and may not be combined with other discounts or offers unless VanDeusen Photography provides written approval.

4. Booking Sessions with Gift Certificates

A gift certificate purchase does not automatically reserve a session date. Sessions must be scheduled separately and are subject to availability.

If a gift certificate is used toward a portrait session, the client is responsible for contacting VanDeusen Photography to schedule the session. Outdoor sessions may be affected by weather, lighting, season, location availability, and safety considerations.

VanDeusen Photography reserves the right to reschedule a session due to weather, illness, emergency, unsafe conditions, location restrictions, or circumstances beyond our control.

5. Product Orders

Because portrait products are custom-created, all product orders are considered final once approved and submitted for production.

This may include, but is not limited to:

Prints
Matted prints
Framed wall portraits
Canvas artwork
Metal prints
Albums
Books
Folios
Image boxes
Storyboards or collages
Custom artwork
Digitally painted or enhanced portraits
Digital image files
Retouching or restoration work

Clients are responsible for reviewing image selections, spelling, names, dates, design proofs, sizes, cropping, finishes, frame choices, and product details before final approval.

Once an order has been approved and submitted to production, it cannot be canceled, refunded, or changed.

6. Color, Cropping, and Product Variations

VanDeusen Photography carefully prepares images and products for professional-quality presentation. However, printed products may vary slightly from what appears on a phone, tablet, or computer screen because screens display color and brightness differently than printed artwork.

Minor variations in color, texture, cropping, paper finish, frame finish, canvas wrap, handmade materials, or product construction are normal and are not considered defects.

7. Digital Image Files

When digital image files are purchased or included with a product, the client receives a personal-use license unless a separate commercial license is provided in writing.

Personal-use digital files may generally be used for:

Personal printing
Personal sharing with family and friends
Personal social media posting
Personal holiday cards, graduation cards, or similar personal uses

Digital files may not be altered, filtered, edited, sold, entered into contests, used for commercial purposes, used in advertising, used for business branding, or provided to third parties for publication without written permission from VanDeusen Photography.

VanDeusen Photography retains the copyright to all images unless a separate written copyright transfer agreement is signed.

8. Commercial Use and Branding Use

Commercial use, business branding use, advertising use, publication use, or promotional use of images requires a separate written license from VanDeusen Photography.

This includes, but is not limited to:

Business websites
Social media advertising
Printed marketing materials
Product packaging
Editorial publication
Commercial displays
Paid promotions
Business cards
Real estate, political, nonprofit, or professional use
Use by third-party companies, organizations, or publications

Unauthorized commercial use may result in additional licensing fees.

9. Shipping, Pickup, and Delivery

If shipping is offered, clients are responsible for providing a complete and accurate shipping address. VanDeusen Photography is not responsible for delays, returned packages, lost packages, or delivery issues caused by incorrect or incomplete address information.

Shipping timelines are estimates and may vary depending on product type, lab production time, vendor availability, weather, holidays, carrier delays, or other circumstances outside our control.

Local pickup or delivery may be available by appointment.

10. Damaged or Defective Products

Please inspect your order promptly upon receipt.

If a product arrives damaged or appears to have a manufacturing defect, notify VanDeusen Photography within five calendar days of receiving the product. Please include photographs of the damaged item, packaging, and any visible shipping damage.

VanDeusen Photography will determine whether the item qualifies for replacement, repair, or lab/vendor review. Damage caused by mishandling, improper storage, heat, moisture, sunlight, pets, children, accidents, or normal wear and tear is not eligible for replacement.

11. Refunds and Cancellations

Due to the custom nature of portrait photography and printed artwork, all sales are final unless otherwise stated in writing.

Gift certificate purchases are non-refundable but may be transferred to another recipient or applied toward eligible VanDeusen Photography services/products.

Custom portrait products, digital files, artwork, albums, image boxes, restoration work, and design services are non-refundable once work has begun, the order has been approved, or the product has been submitted for production.

12. Promotions and Special Offers

Special offers, limited edition sessions, event pricing, bonus gifts, donated certificates, complimentary products, and promotional discounts may include specific terms and restrictions.

Promotions may not be combined unless specifically stated in writing. VanDeusen Photography reserves the right to modify or discontinue promotions at any time, provided that previously purchased gift certificate dollar values will still be honored.

13. Client Responsibility

Clients are responsible for reading product descriptions, gift certificate terms, promotional restrictions, and checkout details before purchasing.

By completing a purchase, the client confirms that they understand what is included and what is not included in the purchase.

14. Availability of Services and Products

VanDeusen Photography reserves the right to update, modify, discontinue, or replace products, collections, session types, vendors, finishes, sizes, frames, albums, or other offerings at any time.

If a product becomes unavailable after purchase, VanDeusen Photography will make reasonable efforts to provide a comparable replacement option.

15. Limitation of Liability

VanDeusen Photography’s liability for any purchase is limited to the amount paid by the client for the specific product, service, or gift certificate at issue.

VanDeusen Photography is not responsible for indirect, incidental, emotional, consequential, or special damages, including but not limited to missed deadlines, lost opportunities, dissatisfaction due to personal preference, or delays caused by third-party vendors or shipping carriers.

16. Copyright and Artistic Discretion

VanDeusen Photography is an artistic portrait business. Final images, retouching, editing style, color treatment, cropping, artwork creation, and product design are completed using the professional judgment and artistic discretion of VanDeusen Photography.

Clients may request specific preferences, and VanDeusen Photography will make reasonable efforts to consider them, but final artistic decisions remain with VanDeusen Photography.

17. Governing Law

These Terms of Sale are governed by the laws of the State of Missouri, without regard to conflict of law principles.
